Are Felons Eligible For Bail?

The answer is technically yes, but in some cases, no. The standards for misdemeanors and felonies are fairly consistent from state to state in most cases. However, this is not the case for felonies in Kansas, which can be met with upwards of one year in prison, with up to $500,000 in fines.

Depending On The Case, A Judge Can Choose To Withhold A Bail Amount For Felonies.

Using a complex grid system, the state compares various factors to determine the severity of the crime. For example, the criminal history of the defendant is considered to be a deciding factor, in addition to the classification of the alleged crime, and whether or not drugs are believed to have been involved. Severity is described in ranges of 1 to 10 if drugs were not involved, or described in ranges of 1 to 5 is drugs were involved. Level 1 is the most severe in these ranges. The criminal history of the defendant is also included, ranged in severity with letters A through I, with A being the most severe in that range.

When looking at the results of this grid, the judge will determine the bail amount for a defendant’s release. In cases where the defendant’s alleged crime is considered as low severity and the defendant does not have a prior criminal record, a felony bail price could range from several hundred to several thousand dollars. Contrarily, if the defendant has a long criminal history, in addition to a severe crime, it is possible that the judge could even choose to withhold the chance for bail at all.
